The terms governing purchases made through the Feuillée Studio website.
This Distance Sales Agreement governs the purchase of products through Feuillée Studio and defines the principal rights and obligations of the Seller and the Buyer.
PARTIES
This Agreement is concluded between the Seller and the Buyer under the terms and conditions set out herein.
DEFINITIONS
For the purposes of this Agreement:
- Seller: Yusuf Özemir, operating under the trading name Feuillée Studio.
- Buyer: the consumer purchasing goods through the Site for purposes outside commercial or professional activity.
- Site: the Feuillée Studio website.
- Goods: the physical products offered for sale through the Site.
- Agreement: this Distance Sales Agreement.
- Applicable Legislation: the mandatory Turkish consumer protection and distance-contract legislation applicable to the transaction.
SUBJECT OF THE AGREEMENT
This Agreement regulates the rights and obligations arising from the remote sale of products ordered by the Buyer through the Site.
The product information, characteristics, applicable price and other relevant information presented to the Buyer before completion of the purchase form part of the applicable transaction.
SELLER INFORMATION
BUYER INFORMATION
The Buyer's name, delivery address, telephone number and e-mail address are obtained during checkout and form part of the relevant order record.
The Buyer is responsible for providing accurate information necessary for processing and delivery of the order.
PRODUCT INFORMATION
The basic characteristics of the product, including its description, materials, specifications, quantity and price, are displayed on the Site before the purchase is completed.
The information displayed for the relevant product at the time of purchase applies to the individual order.
PRICE & PAYMENT
The total amount payable by the Buyer, including applicable taxes and any separately applicable charges, is displayed before the payment process is completed.
The Buyer shall not be subject to an additional payment obligation for optional services unless the required express consent has been obtained.
DELIVERY
The Seller shall fulfil the order within the delivery period communicated to the Buyer and within the mandatory statutory framework applicable to the transaction.
Unless a different legally applicable period has been agreed, the statutory delivery framework for goods shall apply.
The Seller is responsible for loss or damage to the goods occurring until delivery to the Buyer, subject to applicable law.
RIGHT OF WITHDRAWAL
Where the statutory right of withdrawal applies, the Buyer may withdraw from the distance contract within 14 days without giving a reason and without incurring a contractual penalty.
For contracts concerning goods, the withdrawal period generally begins on the date on which the Buyer or a person designated by the Buyer receives the goods.
The Buyer may also exercise the statutory withdrawal right before delivery where permitted under applicable law.
A withdrawal notice may be communicated to the Seller through an appropriate written or permanent-data-medium channel.
EXCEPTIONS TO WITHDRAWAL
The right of withdrawal does not apply where a statutory exception expressly applies.
Relevant statutory exceptions may include goods prepared according to the consumer's request or clearly personal requirements, together with other categories expressly excluded by the applicable legislation.
The fact that a product is handmade does not, by itself, automatically exclude the statutory right of withdrawal. The relevant legal conditions and the actual nature of the individual order shall determine whether an exception applies.
DEFECTIVE GOODS
Where goods are defective or do not conform to the applicable contract, the Buyer retains the mandatory rights granted by applicable consumer legislation.
Nothing in this Agreement shall be interpreted as waiving or restricting mandatory statutory rights concerning defective goods.
NATURAL MATERIAL CHARACTERISTICS
Feuillée Studio products may incorporate natural stones and other natural materials. As individually handmade products, variations in tone, colour, texture, pattern and surface appearance may naturally occur.
Natural materials may also change in appearance over time as a result of normal contact, moisture, oils, cosmetics, environmental conditions and ordinary use.
Natural characteristics or changes consistent with the inherent nature of the material do not, by themselves, constitute a defect. This provision does not restrict any mandatory consumer rights concerning genuinely defective or non-conforming goods.
RETURNS & REFUNDS
Where the Buyer validly exercises a statutory right of withdrawal, the Seller shall process the return and refund in accordance with the mandatory provisions of applicable law.
For approved returns arising from defective goods, Feuillée Studio will cover the applicable return shipping cost.
Feuillée Studio's operational standard for an approved defective-product return is to process the refund on the following business day after the returned product has been received and the necessary inspection has been completed, without limiting any mandatory statutory refund period.
PAYMENT DEFAULT
Where payment is made through a credit card or another payment instrument, any consequences arising from payment default shall be determined in accordance with applicable legislation and, where relevant, the agreement between the Buyer and the applicable payment institution.
DISPUTE RESOLUTION
Consumer disputes arising from this Agreement may be submitted to the competent Consumer Arbitration Committee or Consumer Court in accordance with applicable Turkish legislation and the applicable jurisdictional limits.
EFFECTIVE DATE
This Agreement applies to the relevant order upon completion of the applicable purchase process, subject to all mandatory consumer rights and protections provided by applicable legislation.
The Buyer confirms that the applicable pre-contractual information has been made available before the order is completed.
